The Cost of Uncertainty: How Copyright Law Constrains Artificial Intelligence Innovation in Brazil

The 3rd and final study of the Innovation and Copyright Fellowship series reveals the true cost of regulatory delay for national technology.

The training of generative Artificial Intelligence (AI) systems has revolutionized the global economy and transformed data into strategic inputs. However, in Brazil, this advancement faces a regulatory obstacle: our Copyright Law (Law No. 9,610/98).

Written by researcher Wesley Pena, the study presents a structural problem. Brazilian legislation, conceived in the analog era, does not provide clear exceptions for Text and Data Mining (TDM). The absence of rules for this practice – which is technically essential for AI – affects the competitiveness of national Knowledge-Intensive Business Services (KIBS) companies in direct comparison with powers such as the United States, China, and the European Union.

The research points out that the current scenario suffocates Brazilian technology companies, which face a severe structural disadvantage compared to international competitors operating in countries with more flexible and modern copyright regimes.
